In this regard, it was possible to conclude that there is no uniformity in the analysis methodology for the exercise of diffuse control, and that between said Constitutional Chamber and the Permanent Criminal Chamber of the Supreme Court, frontally opposed pronouncements were issued in similar cases, despite the existence of the binding jurisprudential doctrine established in Cassation No. 335-2015 of Santa.El presente artículo analizó cuatro ejecutorias de la Sala de Derecho Constitucional y Social Permanente de la Corte Suprema correspondientes al año 2018, cuyos fallos presentaban votos en discordia respecto a la inaplicación del segundo párrafo del artículo 22 del Código Penal, en los casos de robo agravado y de violación sexual de menor de edad.
