Es una publicación semestral de carácter científico, editada por la Facultad de Derecho y Ciencias Sociales de la Universidad ESAN. Su misión es contribuir al conocimiento jurídico mediante la publicación de trabajos de investigación académica originales y especializados en Derecho Corporativo y temas jurídicos afines, con relevancia tanto nacional como internacional.     Arbitraje de inversiones versus arbitraje Uncitral: un análisis desde la perspectiva procesal

    For more than sixty years, international investment law has become an extraordinary way to generate legal certainty in the economic development of an increasingly global world. In this sense, investment treaties have contributed through the incorporation of ISDS clauses to offer a framework for the resolution of investment disputes between international business corporations and the various States, which offers guarantees of neutrality and procedural security in the management of the conflict. In this article, we offer a critical analysis of investment arbitration. Based on the comparative analysis, we appreciate notable differences between UNCITRAL arbitration and investment arbitration, pointing out some problems of the current investment arbitration model.

    ¿Y si vamos a arbitraje? El arreglo interino multipartes de arbitraje: análisis y vacíos legales

    In December 2019, the period of two member of the Appellate Body expired. Consequently, the Appellate Body became an inoperative institution. In this context, a group of Members of the WTO negotiated an alternative mechanism to settle their disputes: “The Interim Multi-Party Arbitration Agreement”. This paper analyses the functioning of this instrument, evinces some of the aspects not resolve by this instrument and explains that the reform of the dispute settlement system of the WTO is part of a bigger problem related to the need to reform the WTO.

    Los precedentes del tribunal constitucional en el arbitraje

    The arbitration in our country has been impacted by the decisions of the Constitutional Court. These decisions have had such importance in the arbitration activity, not only because of the content of the interpretations, but because these interpretations have been given the connotation or precedent status. Precisely, it is the reason for this work to present the two precedents that the Court has set in arbitration to reflect on how successful are the rules of jurisprudential creation and how these statements impact on legal security.
