dc.description.abstractThis article analyzed four final decisions of the Permanent Constitutional and Social Law Chamber of the Supreme Court corresponding to the year 2018, whose rulings presented dissenting votes regarding the non-application of the second paragraph of article 22 of the Penal Code, in cases of aggravated pressthe robbery and rape of a minor. In this regard, it was possible to conclude that there is no uniformity in the analysis methodology for the exercise of diffuse control, and that between said Constitutional Chamber and the Permanent Criminal Chamber of the Supreme Court, frontally opposed pronouncements were issued in similar cases, despite the existence of the binding jurisprudential doctrine established in Cassation No. 335-2015 of Santa.en_EN
dc.description.abstractEl presente artículo analizó cuatro ejecutorias de la Sala de Derecho Constitucional y Social Permanente de la Corte Suprema correspondientes al año 2018, cuyos fallos presentaban votos en discordia respecto a la inaplicación del segundo párrafo del artículo 22 del Código Penal, en los casos de robo agravado y de violación sexual de menor de edad. Al respecto, se pudo concluir que no existe uniformidad en la metodología de análisis para el ejercicio de control difuso, y que entre dicha Sala Constitucional y la Sala Penal Permanente de la Corte Suprema se emitieron pronunciamientos frontalmente opuestos ante casos similares, pese a la existencia de la doctrina jurisprudencial vinculante establecida en la Casación N.° 335-2015 del Santa.es_ES
