Control de la discrecionalidad: hechos determinantes y conceptos jurídicos indeterminados. Caso Muente Schwarz ante el tribunal del servicio civil peruano

Abstract

Based on the sanction imposed on the president of Osiptel, evaluated by the Civil Service Tribunal, the practical utility of determining facts and indeterminate legal concepts in the disciplinary sphere is analyzed. To this end, discretion and the mechanisms available for its control are examined, with the aim of reducing the risks of arbitrariness and abuse of power. It is emphasized that its application can be carried out both in administrative and contentious-administrative settings. Each of these mechanisms is then examined in depth, with special emphasis on those that are the subject of analysis. The tribunal's decision is then addressed, identifying both the reasons for the invalidity of the investigating authority and the inconsistencies of the tribunal itself. Using hermeneutical, sociological, and historical techniques, it is concluded that it is essential for the authority to fully identify the facts using these tools for controlling discretion.

A partir de la sanción impuesta al presidente del Osiptel, evaluada por el Tribunal del Servicio Civil, se analiza la utilidad práctica de los hechos determinantes y los conceptos jurídicos indeterminados en el ámbito disciplinario. Para ello, se examinan la discrecionalidad y los mecanismos disponibles para su control, con el fin de reducir riesgos de arbitrariedad y abuso de poder. Se destaca que su aplicación puede realizarse tanto en sede administrativa como en sede contencioso-administrativa. Posteriormente, se profundiza en cada uno de estos mecanismos, con especial énfasis en aquellos que son objeto de análisis. Más adelante, se aborda la decisión del tribunal, identificando tanto los motivos de nulidad de la autoridad instructora como las inconsistencias del propio colegiado. Con el uso de las técnicas hermenéuticas, sociológicas e históricas, se concluye que resulta imprescindible que la autoridad identifique plenamente los hechos mediante dichas herramientas de control de la discrecionalidad.
