| dc.description.abstract | El presente trabajo examina las bases histórico-dogmáticas de la responsabilidad penal corporativa a partir de un análisis sistemático de fuentes normativas, teológicas, filológicas, lingüísticas y contextuales que permiten identificar manifestaciones tempranas de punibilidad colectiva. En particular, se desarrolla un estudio detallado de las expresiones premodernas y contemporáneas de adscripción punitiva a las corporaciones, con el fin de precisar en qué medida han existido y subsisten criterios praeterjurídicos y normativos orientados a imputar hechos punibles a entes colectivos. Sobre dicha base, se cuestiona la communis opinio que asocia la responsabilidad penal de las personas jurídicas a tres afirmaciones ampliamente difundidas en la literatura especializada: la supuesta inexistencia de un régimen de responsabilidad penal corporativa en el derecho romano, la atribución del aforismo societas delinquere non potest al canonismo medieval y el presunto origen exógeno de la imputación penal corporativa. Finalmente, se concluye que tales premisas carecen de un soporte argumentativo sólido, mostrando cómo los dilemas histórico-dogmáticos persisten, resuenan e influyen en los ordenamientos jurídicos latinoamericanos contemporáneos. | es_ES |
| dc.description.abstract | This study examines the historical-dogmatic foundations of corporate criminal liability on the basis of a systematic analysis of normative, theological, philological, linguistic, and contextual sources that reveal early expressions of collective punishability. The study particularly offers a detailed examination of premodern and contemporary manifestations of punitive ascription to corporations, seeking to determine to what extent praeter-legal and normative criteria have existed and continue to persist for imputing criminal acts to collective entities. On this basis, it challenges the communis opinio linking legal persons' criminal liability to three widespread assertions in specialized literature: the alleged absence of a corporate criminal liability regime in Roman law, the attribution of the maxim societas delinquere non potest to medieval canon law, and the presumed exogenous origin of corporate criminal imputation. The analysis concludes that these premises lack solid argumentative support, while revealing how historical-dogmatic dilemmas continue to resonate and exert influence in contemporary Latin American legal systems. | en_EN |
