Ítem Solo Metadatos Desarrollo sostenible en las empresas del Perú: ¿voluntario u obligatorio?(Universidad ESAN, 2023-12-31) Ruiz Vásquez, Úrsula PatriciaThe objective of this article is to determine whether compliance with the concept of sustainable development, by companies in Peru, is voluntary or mandatory, based on a detailed review of literature related to corporate social responsibility, sustainability reports or reports, companies. with B certification and BIC society; as well as the analysis of various rulings of the Constitutional Court about some of these concepts and our social market economy regime. Based on the results of the aforementioned analysis, it will be possible to determine that Peruvian companies, in addition to generating economic profitability, need to incorporate social and environmental components into their management, through absolutely measurable, verifiable and sustainable actions that contribute to present and future generations of the country can enjoy a dignified life.Ítem Solo Metadatos El medio ambiente: alcances desde la jurisprudencia(Universidad ESAN, 2023-06-30) Morán Valdez, Marcos Omar; Vásquez Sánchez, José RonaldThis article deals with some aspects of the environment and its legal protection from the perspective of the highest courts of justice. In this sense, as an initial approximation, a small development of the importance of the environment in the evolution of human life is made. Likewise, two sentences issued by the Peruvian Constitutional Court, by the Supreme Court of Justice of Peru and by the European Court of Human Rights are discussed, and Advisory Opinion OC-23/17 of the Inter-American Court of Human Rights is also discussed, which allow clarifying concepts such as the environment, constitutional protection of the environment, environmental damage, sustainable development, environmental social responsibility, among others.Ítem Solo Metadatos Desarrollo sostenible en turismo: una propuesta para Machu Picchu(Universidad ESAN. In the first section, statistics show Peru is basically a unipolar travel destination. The second section presents the complex problems identified at the Sanctuary. The signing of the FTA has led Peru to leave behind a view of the environment vision as a moral and ethical (some times marginal) component of economic relations, to turn it into a regulatory and mandatory consideration overlapping trade and investment to such an extent that failure to comply may lead to sanctions as severe as those pertaining to other matters related to for instance access to or permanence in a given market. Classical economists hold that the most important challenge for a country was to create wealth. However, as time goes by, other important and complementary concepts have arisen such as development, sustainable development and social capital, stressing out the need for creating human, institutional and natural capacities to generate lasting well-being. Capacities do not come besides investment; we need to create them. However, some examples show that many public and private decision-makers in Peru do not take into account such need; they prioritize economic capacities and neglect social, environmental and institutional ones. In this sense, it differs from "living better" — an individualistic interpretation of life—, far from respecting the natural environment and which deifies the economic activity. Thus, this contribution aims to introduce a conceptual framework regarding «good living» to understand that the operational function of social welfare cannot be addressed in a unidimensional way, just considering the economy, but also environmental variables, such as public health, quality of life, social integration, access to social rights, among others. All this has an impact on the identification of indicators that also measure these variables, intending to allow all the people to be drivers in social, political, and economic development in a sustainable manner.Ítem Solo Metadatos La administración del desarrollo sostenible en el contexto de la economía social de mercado(Universidad ESAN. ESAN Ediciones, 2007-12-30) Vera, José CarlosThe theory of market social economy appears neatly when dealing with environmental conservation and the search for the wellbeing of the underprivileged. These concepts have been used in various countries and today it is possible to see countries that carefully watch over their environment and have achieved signifi cant social balance. Peru has not been alien to environmental and social concepts and for more than four decades has establishes organizations, designed policies and enacted laws to look at these issues. However, the outcomes have been limited. Among the reasons that explain the ineffectiveness of such regulations and institutions perhaps among the most important are the lack of effective oversight and control over economic agents, and an ineffi cient design of the ways to attain goals through regulations and institutions. For that reason, this paper proposes policy options to correct market outcomes and a way to build institutions that will allow to accomplish the desired goals.
